Terms and conditions of sale




Capitalized terms used herein without prior definition shall have the meanings set forth below:

"Customer" means a natural person of legal age, acting for personal or professional purposes and having full legal capacity to enter into commitments hereunder. The Customer may also refer to a legal entity with full legal capacity to enter into commitments hereunder.

"Conditions of sale of the reserved fare" refers to the specific conditions of each reservation made by the Customer.

"Booking Confirmation" means the document summarizing the details of the booking made by the Customer, sent by the website or the Establishment to the Customer.

"Reservation Request" refers to any request made by the Customer to reserve the Gite.

"Establishment" refers to the gite "Le Clos Peyrière", operated by Mrs Girard and Mr Duchanaud, located at 95F, Chemin du Méou 84360 in LAURIS.

"Partners" refers to all service providers who have entered into a service contract or partnership agreement with the Establishment.

"Service" refers to any gite booking service provided by the Customer on the Establishment's website.

"Establishment Website" refers to the website dedicated to the Establishment, accessible at the following address https://www.leclospeyriere.fr.

ARTICLE I - Preamble

Reservation of the gite implies acceptance of the General Conditions set out below in their entirety.

ARTICLE II - General provisions

The owner undertakes to be personally present at the arrival of guests and to give them the warmest welcome. We welcome guests from 4:00 pm to 6:00 pm.

ARTICLE III - Length of stay

The customer who signs the present contract concluded for a fixed period will not be able under any circumstances to take advantage of any right to remain in the premises at the expiry of the period initially envisaged on the present contract.

ARTICLE IV - Reservations

1. The Customer selects the services he wishes to reserve on the website, according to the following procedures:

3. Selection of additional services, if any.

4. Check and validate booking details, total booking amount, fare conditions.

5. Provide contact details.

6. Enter credit card details in case of guarantee or prepayment.

7. Consultation and acceptance of the general conditions of sale and the conditions of the fare selected before validating the booking.

8. Confirmation of booking.

The Customer acknowledges that he/she is aware of the nature, destination and reservation terms of the Services offered by the Site, and that he/she has requested and obtained the information necessary to make a reservation with full knowledge of the facts. The Customer is solely responsible for his or her choice of Services and their suitability for his or her needs, such that the Establishment cannot be held liable in this respect.

The Customer undertakes to complete the information requested on the reservation request and attests to the truthfulness and accuracy of the information provided.

Contractual information is presented in French and English, and is confirmed at the latest when the reservation is validated by the Customer.

For bookings made exclusively via the Internet, a booking is registered on the Service Provider's website when the Customer accepts these General Terms and Conditions of Sale by ticking the appropriate box and validates the booking. The Customer has the opportunity to check the details of his reservation, its total price and to correct any errors before confirming his acceptance (article 1127-2 of the French Civil Code). Confirmation implies acceptance of the present General Sales Conditions in their entirety, and constitutes proof of the sales contract.

It is therefore the Customer's responsibility to check the accuracy of the reservation and to immediately report any errors.

The sale of Services will only be considered definitive once the Service Provider has sent the Customer confirmation of acceptance of the reservation by e-mail, and once the Customer has received payment in full.

Any reservation made on the Site's website constitutes the formation of a distance contract between the Customer and the Supplier.

The Establishment reserves the right to cancel or refuse any reservation from a Customer with whom there is a dispute relating to the payment of a previous reservation.

Each reservation is nominative and may under no circumstances be transferred to a third party.

ARTICLE V - Rates

The Services offered by the Provider are provided at the rates in force on the Site's website at the time the reservation is recorded by the Provider. Prices are expressed in Euros and include VAT.

Prices take into account any discounts granted by the Provider under the conditions specified on the Site's website.

These prices are firm and non-revisable during their period of validity, as indicated on the Site's website. The Provider reserves the right, outside this period of validity, to modify prices at any time.

Prices are indicated before and at the time of booking by the Customer. They apply to the entire gite, for the number of people and the date selected.

Rates are confirmed to the Customer in the Establishment's commercial currency. They include VAT at the rate applicable on the day of booking; any change in the applicable VAT rate will automatically be reflected in the rates indicated on the date of invoicing. The same will apply to any modification or introduction of new legal or regulatory taxes imposed by the competent authorities.

Unless otherwise stated on the Site, ancillary services are not included in the price.

Conversion into foreign currency is given for information only and is non-contractual. If a rate involves payment directly to the Establishment on the Customer's arrival or departure, and the Customer's currency is not the same as that of the Establishment, the rate debited by the Establishment may differ from that communicated at the time of booking, taking into account changes in the exchange rate between the date of booking and the date of payment.

An invoice is drawn up by the Service Provider and given to the Customer when the reserved Services are provided.

ARTICLE VI - Terms of payment

Payment for the stay is made according to the terms indicated at the time of booking, such as the total amount, any service charges and cancellation conditions applicable, as well as the tourist tax. Cancellation and modification conditions vary according to the type of reservation and rates.

a. Standard" rates

All reservations must be guaranteed by a credit card valid on the date of arrival.

* A deposit of 50% of the total amount will be taken at the time of booking.

* The balance, 50% of the total amount, will be taken 14 days before your arrival.

* A deposit of 800€ will be blocked on your credit card before your arrival.

Any request for modification of one or more services with regard to the reservation validated by the establishment must be sent by e-mail to the establishment.

The modification can only be accepted and confirmed according to the establishment's availability and possibilities at the time of the request. It may be likely to generate a cost of tariff readjustment.

Cancellation :

No cancellation fees apply before 6:00 pm (local time), up to 30 days before arrival. After this date, the full amount of the reservation is due.

Cancellations made before this date will result in a refund of the payment made at the time of booking.

The reservation becomes effective once the customer has sent the owner a deposit of 50% of the total price of the stay, with a minimum of seven nights for the entire gite, excluding extras.

All services will be detailed and mentioned on the invoice given to the customer, who will be able to proceed to payment by secure means (by Visa, MasterCard, American Express or other Ecard bleue credit cards).

Payment data is exchanged in encrypted mode using SSL protocol.

The Customer may be asked to show proof of identity as part of procedures to prevent credit card fraud.

The Service Provider shall not be obliged to provide the Services ordered by the Customer if the price has not first been paid in full in accordance with the above conditions.

Payments made by the Customer shall not be considered final until actual receipt of the sums due by the Service Provider.

b. The "Non-Modifiable and Non-Refundable" rate

Reservations are non-changeable and non-refundable.

The total amount of the booking will be debited from your credit card immediately after confirmation of the booking. The price of the gite includes tourist tax. In case of no-show or cancellation, no refund will be made.

* A deposit of 800€ will be blocked on your credit card before your arrival.

In the event of no-show on the first night and no late warning, the entire stay will be cancelled.

The price is payable in cash, in full, on the day the reservation is confirmed by the customer, in accordance with the terms specified in the "Reservations" article above, by secure payment (via the Etablissement's website, by Visa, MasterCard, American Express or other Ecard bleue credit cards)

At the time of booking, the customer provides his/her bank details, specifying the name of the credit card, the credit card number, the validity date (the credit card must be valid until the end date of the stay) and the cryptogram.

Payment data is exchanged in encrypted mode using SSL protocol.

The Customer may be asked to show proof of identity as part of procedures to prevent credit card fraud.

The Service Provider shall not be obliged to provide the Services ordered by the Customer if the price has not first been paid in full in accordance with the above conditions.

Payments made by the Customer will only be considered final once the amounts due have been received by the Service Provider.

ARTICLE VII - Provision of Services

The Services booked by the Customer, which include the reservation of the gite and ancillary services, will be provided in accordance with the following terms and conditions, which the Customer has read and accepted when booking on the Establishment's website.

The Establishment is an entirely non-smoking indoor space. The customer will be held responsible for any direct and/or indirect, consequential damage resulting from smoking in the Establishment. They will therefore be liable for the full cost of cleaning and restoring the damaged item or area to its original state.

Pets are not allowed unless otherwise agreed. In the event of a customer's departure due to the refusal of his or her pet, no reimbursement will be made.

Customers are entirely responsible for any personal belongings left in the establishment. The establishment cannot be held responsible for the loss, theft, deterioration or damage caused to said belongings.

The customer accepts and undertakes to use the premises with due care. Any behavior contrary to good morals and public order will lead the Establishment to ask the Customer to leave the establishment without any compensation or refund if payment has already been made.

The Customer will be held responsible for all direct and/or indirect, consequential damage caused by him/her in the Establishment. Consequently, the customer undertakes to compensate the Establishment for the amount of said damages, without prejudice to any damages and interest that may be due, as well as legal and court costs incurred by the Establishment.

Free WIFI access enabling customers to connect to the Internet is provided in accordance with the Establishment's current policy. The Customer undertakes to ensure that the computer resources made available by the Establishment will not be used in any way for the purposes of reproduction, representation, making available or communication to the public of works or objects protected by copyright or related rights, such as texts, images, photographs, musical works, audiovisual works, software and video games, without the authorization of the holders of the rights provided for in Books I and II of the Intellectual Property Code, where such authorization is required. Should the customer fail to comply with the aforementioned obligations, he or she risks being accused of counterfeiting (article L.335-3 of the French Intellectual Property Code), punishable by a fine of 300,000 euros and three years' imprisonment. The customer is also required to comply with the security policy of the Establishment's Internet service provider, including the rules governing the use of the security measures implemented to prevent the illicit use of IT resources, and to refrain from any action that might undermine the effectiveness of these measures.

Unless expressly agreed otherwise, the gite will be made available to the Customer on the day of arrival from 4 pm and the Customer will leave the gite on the day of departure by 12 noon at the latest. Failure to do so will result in the Customer being charged for an additional night's stay. Customers must check their departure date.

The Service Provider undertakes to use its best efforts to provide the Services booked by the Customer, on a best-efforts basis.

The Customer has a period of 8 days from the date of departure from the Premises in which to submit written reservations or complaints concerning the provision of the Services, together with all relevant supporting documents, to the Premises.

No claim will be validly accepted if the Customer fails to comply with these formalities and deadlines.

In the absence of reservations or complaints expressly made within this time limit by the Customer upon receipt of the Services, the latter will be deemed to conform to the reservation, in terms of quantity and quality.

In the event of an exceptional event, force majeure or the impossibility of making the reserved gite available to the Customer, the Establishment reserves the right to accommodate the Customer in whole or in part in an Establishment of equivalent category, for services of the same nature and subject to the prior agreement of the Customer.

ARTICLE VIII - Right of withdrawal

In accordance with article L 221-28 of the French Consumer Code, the Customer does not have the right of withdrawal provided for in article L 221-18 of the French Consumer Code, given the nature of the services provided.

The contract is therefore definitively concluded as soon as the reservation is made by the Customer in accordance with the terms and conditions specified in these General Terms and Conditions of Sale.
